These Terms of Service govern your use of presideworks.com and any project, retainer, or service engagement with Preside Works ("we", "us", "our"). By engaging us for a project or using this site, you agree to these terms.

1. Services

We provide website design & development, SEO, and performance marketing services as described on our service pages. The exact scope, deliverables, and timeline for your project are confirmed in writing (via proposal, quote, or invoice) before work begins; that document takes precedence over the general descriptions on this site if there's ever a conflict.

2. Payment terms

  • Projects are secured with a 50% advance payment before work begins, with the balance due before final delivery/handover unless otherwise agreed in writing for a specific project.
  • Ongoing retainers (SEO, performance marketing, maintenance) are billed monthly in advance.
  • Domain and hosting costs are not included in our fees and are purchased separately, in the client's name where possible.
  • Any premium plugins, themes, stock assets, payment gateway charges, or other third-party costs required for a project are discussed and approved with you before purchase. All costs are disclosed upfront, no surprise charges.
  • For performance marketing, your advertising budget is billed directly by Google/Meta and is always separate from our management fee; we never mark up ad spend.

3. Revisions

The number of revision rounds is confirmed in your written proposal. Extra rounds, if needed, are quoted before they start.

4. Cancellations and refunds

See our separate Refund & Cancellation Policy for full details. In short: once your advance payment is made and work has started, it is non-refundable in cash; if you need to stop a project partway through, we'll apply the value already paid toward completed work or an equivalent alternative deliverable rather than issuing a cash refund.

5. Ownership & intellectual property

Once a project is paid in full, ownership of the final agreed deliverables (the website files, designs, and content created specifically for you) transfers to you. We may retain the right to showcase completed work in our portfolio and marketing materials, unless you request otherwise in writing.

Any third-party assets used in your project (stock photography, licensed fonts, plugins, themes) remain subject to their own licence terms.

6. Client responsibilities

Timely delivery depends on you providing content, feedback, approvals, and access (e.g. to domain/hosting accounts) when we ask for them. Delays on your end may shift the delivery timeline accordingly.

7. No guaranteed results

For SEO and performance marketing specifically: we don't guarantee specific rankings, traffic, or ad performance numbers, since these depend on factors outside our control (competition, platform algorithm changes, market conditions). We do commit to the scope of work, effort, and reporting described in your proposal.

8. Limitation of liability

To the extent permitted by law, our liability for any claim relating to our services is limited to the amount you've paid us for the specific project or retainer in question.

9. Governing law

These terms are governed by the laws of India, and any disputes will be subject to the jurisdiction of the courts in Mumbai, Maharashtra.
